TERMS AND CONDITIONS OF THE ONLINE STORE

§1

General provisions La Monetti online store conducts retail sales via the Internet, based on these regulations.

  2. The Regulations are an integral part of the sales contract concluded with the Customer.
  3. The condition for concluding a sales contract is the acceptance of the Regulations by the Customer.
  4. Orders through the website www.lamonetti.com may only be placed by adults.
  5. The prices given in the store are gross prices.
  6. The goods available in the store are free from physical and legal defects.

§2

Orders

  1. Orders can be placed as follows:
    • a) via the form available on the store’s website,
    • b) online on Facebook during live and on the fb page
  2. The condition for the execution of the order is the provision by the Customer of data allowing for the verification of the Customer and the recipient of the goods. The store has the right to refuse to accept an order, limit the method of payment or demand prepayment in the event that the order raises reasonable doubts as to the veracity and reliability of the data provided or the method of payment.
  3. The parties are bound by the information contained on the store’s website with the purchased goods at the time of placing the order, in particular: price, characteristics of the goods, its features, elements included in the set, date and method of delivery.

The sales contract is concluded when the Customer confirms the order in the store’s basket and presses the “Buy” button.

§3

Payments

  1. The customer can choose from various payment methods specified in the Payment methods tab.
  2. Shipping prices are specified in the delivery price list.
  3. The condition for the release of the ordered goods is the payment for the goods and the shipment.

§4

Shipment of goods

  1. The ordered goods are sent by the store via Royal Mail
  2. Personal collection is possible only with the consent of the online store. The store may refuse to accept personal collection.
  3. In the case of payment by a payment card, the order completion date is counted from the moment of positive authorization of the transaction.
  4. In the case of payment other than cash on delivery, the shipping date is extended by the period between placing the order and the date of posting the payment on the store’s bank account.
  5. The total waiting time for the package is the delivery time + delivery time. up to 5 working days
  6. Due to the large number of orders and updating of stock levels only once a day, we would like to inform you that in rare cases there may be a situation in which the ordered goods are already sold out. In such situations, we contact you and refund you the full cost of the payment.
  7. Shipments of parcels ordered to countries outside the UK may be subject to customs duties as they go through customs control.

§5

Complaints

 

  1. The store responds to the customer’s complaint within 14 working days from the moment of returning the goods together with a description of the non-compliance. In the event that the verification of non-compliance requires seeking the opinion of an expert or a representative of the manufacturer of the goods, the deadline for the store’s response is extended by the time the store obtains such an opinion.
  2. When the implementation of a justified complaint involves sending a new product to the Customer or removing non-compliance, the delivery costs are borne by the store.
  3. Individual settings of the Customer’s computer and monitor resulting in incorrect or distorted display of information about the goods (e.g. colors) cannot be the basis for a complaint.

§6

Right of withdrawal

    1. The customer (consumer) has the right to withdraw from the contract of sale of products purchased in the www.lamonetti.com store, without giving a reason within 14 days of their delivery according to the general rules resulting from provisions of the Act of May 30, 2014. on consumer rights (Journal of Laws of 2014 No. 827).
    2. The customer returns the goods to the Store within 14 days of submitting a statement of withdrawal from the contract. We return the product unchanged, unless the change was necessary as part of ordinary management. The product should be returned in its original packaging, complete with no signs of use. Shipping costs are borne by the buyer if a different form of shipping than the cheapest was chosen. The return form can be downloaded here (return form)
    3. Within 3 business days of receiving the shipment, the store will check the condition of the delivered product.
    4. Within 14 days of delivering the returned item to us and checking the goods, the store returns the amount paid to the Customer. The customer should indicate the bank account number to which the refunded amount is to be transferred. In the case of payment by credit card, the refund will be made to the card.
    5. In the event of a breach by the Customer of the conditions set out in paragraphs 2 and 3 above, the declaration of withdrawal from the contract is ineffective, the goods are not refundable, and the store does not return the amount paid to the Customer.
    6. The Customer is not entitled to the right of withdrawal
      In cases specified in Art. 10 sec. 3 of the Act specified in sec. 1 above, i.e. in the scope of:

      • a) the provision of services started, with the consent of the Customer, before the deadline for withdrawing from the contract (applies to the provision of services, not the sale of goods),
      • b) audio and visual recordings and recorded on IT data carriers after the Customer has removed their original packaging,
      • c) contracts for services for which the price or remuneration depends solely on price movements on the financial market,
      • d) services with properties specified by the Customer in the order placed by him or closely related to his person,
      • e) benefits which, due to their nature, cannot be returned or the subject of which is subject to rapid deterioration,
      • f) delivering the press,
      • g) gambling services.

§7

Privacy protection

  1. By placing an order, the Customer agrees to the processing of his personal data only for the purpose of order fulfillment.
  2. The customer may give separate consent to receive advertising and promotional materials from the store, including a commercial newsletter.
  3. The customer has the right to inspect and correct his data, as well as to request removal.

§8

Intellectual property

It is forbidden to use any materials published on the store’s website (including photos of banners and descriptions of goods) and the store’s graphic design without the store’s written consent. Please be advised that all materials posted on the WEBSITE are legally protected in accordance with the Act of February 04, 1994 on copyright and related rights and the Act of June 30, 2000

§9

Entry into force and amendments to the Regulations

  1. The Regulations come into force on the day of publication on the store’s website.
  2. The store reserves the right to change the Regulations, which come into force on the day of their publication on the store’s website. For contracts concluded before the amendment to the Regulations, the version of the Regulations in force on the date of placing the order by the Customer shall apply.

Final Provisions.

In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
